Your Question: John quit 6 months ago and now wants a copy of his personnel file. Do we have to give him a copy?
Response: Ex-employees are entitled to inspect and get copies of certain documents in their "personnel file." We discuss the specifics of these rights (and the regulations for Labor Code §1198.5) in Memos:
- 5203 Access to Personnel Files
- 5200 What Belongs in Personnel Files
- 5205 Employer's Right to Control Inspection & Copying
Thank you.
